By accessing and using the Brixato website and our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.
These terms apply to all visitors, users, and customers of our software development, technology consulting, and cloud solutions services.
2. Description of Services
Brixato provides the following professional services:
- Custom software development and web applications
- Technology consulting and digital transformation
- Cloud solutions and infrastructure
- Artificial intelligence and machine learning integration
- System maintenance, support, and optimization
- Security audits and regulatory compliance
Specific details of each service will be defined in individual contractual agreements between Brixato and the client.
3. User Accounts
To access certain services, you may need to create an account. You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the security of your password and credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent activities.
4. Intellectual Property
All intellectual property rights related to our website, content, designs, and materials are owned by Brixato or our licensors.
- Source code: Rights to developed code will be defined in the specific project contract
- Documentation: Technical documentation delivered to the client is for exclusive project use
- Trademark: The "Brixato" name and logo are registered trademarks
- Third-party licenses: Some projects may include third-party software with their own licenses
5. Acceptable Use
By using our services, you agree NOT to:
- Use services for illegal or unauthorized purposes
- Attempt to access systems or data without authorization
- Interfere with the security or operation of our services
- Send spam, malware, or malicious content
- Violate third-party intellectual property rights
- Reverse engineer our products
- Resell or redistribute our services without authorization
6. Payments and Billing
Payment terms will be established in individual project contracts:
- Quotes: Valid for 30 days unless otherwise indicated
- Payments: According to agreed schedule (deposits, milestones, final delivery)
- Payment methods: Bank transfer, credit card, PayPal
- Late payments: Overdue payments may incur 1.5% monthly interest
- Suspension: We may suspend services for non-payment
All prices are subject to applicable taxes (VAT/IGIC).
7. Warranties and Support
Brixato commits to providing high-quality services:
- Code warranty: 90 days for defects in delivered code
- Technical support: According to contracted plan (basic, standard, premium)
- Updates: Critical security patches at no additional cost during warranty period
- SLA: Service level agreements defined by contract
Warranties do not cover issues caused by misuse, unauthorized modifications, or external factors.
8. Confidentiality
Both parties commit to maintaining confidentiality of shared information:
- Commercial and strategic client information
- Source code and system architecture
- User and end-client data
- Proprietary methodologies and processes
We sign non-disclosure agreements (NDA) when the project requires it.
9. Limitation of Liability
To the extent permitted by law, Brixato shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Interruptions caused by external factors (internet, third-party hosting)
- Actions of third parties or external integrations
Our total liability shall not exceed the amount paid for the service in the last 12 months.
10. Cancellation and Termination
Either party may terminate a project under the following conditions:
- Client cancellation: With 30 days prior notice, subject to compensation for work performed
- Brixato termination: For non-payment or violation of terms
- Ongoing projects: Completed work and incurred expenses will be billed
- Material delivery: Upon full settlement of outstanding payments
11. Modifications to Terms
We reserve the right to modify these terms at any time. Significant changes will be notified at least 30 days in advance. Continued use of our services after modifications constitutes acceptance of the new terms.
12. Applicable Law and Jurisdiction
These terms are governed by the laws of Spain. Any dispute will be resolved in the courts of Madrid, Spain, unless the client has the right to file claims in their local jurisdiction according to applicable legislation.
13. Severability
If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
